メイクアップアーティスト 利用規約

第1条（適用）
本利用規約（以下「本規約」）は、株式会社 appful（以下「当社」）が提供するアプリ「メイクアップアーティスト」（以下「本アプリ」）の利用に関する条件を定めるものです。利用者は、本規約に同意のうえ、本アプリを利用するものとします。未成年の方は、保護者の方の同意を得てから利用してください。
第2条（利用環境）
本アプリは、iOS 18.0 以降の iPhone を動作環境とします。OS のバージョンや端末によっては、一部の機能が制限される場合があります。
第3条（アカウントとデータ）
本アプリは、アカウントの登録を必要としません。作ったメイク、遊びの進み具合などのデータは、すべて利用者の端末の中に保存されます。本アプリの削除、端末の故障・紛失などによって失われたデータを、当社が復元することはできません。
第4条（広告）
本アプリは無料で利用できます。本アプリには、第三者（Google LLC）が配信する広告が表示されます。広告の取り扱いは、プライバシーポリシーに定めます。
第5条（有料の商品「広告をなくす」）
- 本アプリでは、有料の商品「広告をなくす」（買い切り）を販売します。購入すると、本アプリに広告が表示されなくなります。
- 価格は、App Store の購入画面に表示される金額（消費税込）とします。
- 支払いは、Apple ID に紐づく決済方法により、購入の確定時に行われます。
- 未成年の方は、保護者の方の同意を得てから購入してください。
- 本アプリを入れ直した場合や、同じ Apple ID の別の端末では、本アプリの「購入を復元」から購入した内容を戻すことができます。
- 商品の性質上、購入後の返品・返金・キャンセルはお受けしておりません。本アプリの不具合などにより商品が正しく反映されなかった場合は、第12条のお問い合わせ先までご連絡ください。Apple の返金ポリシーに基づく返金の請求は、App Store にて直接お申し込みください。
第6条（メイクの絵について）
本アプリのメイクの絵、商品・色・道具とその説明は、遊びのためのものです。実際の化粧品の効果や、実際の肌に合うかどうかを示すものではありません。
第7条（禁止事項）
利用者は、次の行為を行ってはなりません。
- 法令または公序良俗に違反する行為
- 本アプリのリバースエンジニアリング、改変、再配布
- 不正な方法で有料の商品を利用する行為
- 他者の権利を侵害する行為
- 本アプリの正常な運営を妨げる行為
第8条（知的財産）
本アプリおよび関連する一切のコンテンツ（プログラム、イラスト、デザイン、ロゴ、テキストなど）の知的財産権は、当社または正当な権利者に帰属します。
利用者は、本アプリで作ったメイクの絵を、個人で楽しむ範囲（写真への保存や、SNS でのシェアを含みます）で利用できます。営利を目的とする利用はできません。
第9条（本アプリの変更・提供の終了）
当社は、本アプリの内容を変更し、または本アプリの提供を終了することがあります。
第10条（免責事項）
- 当社は、本アプリが利用者の特定の目的に適合すること、欠陥がないこと、安全であること、誤りがないことを保証しません。
- 当社は、本アプリの利用または利用できないことから生じた損害について、当社に故意または重大な過失がある場合を除き、責任を負いません。
- 広告の内容は、広告を配信する第三者が提供するものです。広告から移った先のサービスについては、その提供者の定めに従ってください。
- 利用者と Apple、その他の第三者との間で生じた紛争については、利用者が自己の責任で解決するものとします。
第11条（規約の変更・準拠法・管轄）
- 当社は、必要と判断した場合、本規約を変更できます。変更後の規約は、本ページに掲載した時点から効力を生じるものとします。
- 本規約は日本法に準拠し、本規約に関連して生じる一切の紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Makeup Artist Terms of Service

Article 1 (Scope)
These Terms of Service (the "Terms") set out the conditions for using the app "メイクアップアーティスト" (Makeup Artist; the "App") provided by appful Inc. ("we", "us"). You use the App after agreeing to these Terms. If you are a minor, please get your parent's or guardian's consent before using the App.
Article 2 (Requirements)
The App runs on iPhone with iOS 18.0 or later. Some features may be limited depending on the OS version or device.
Article 3 (Account and data)
The App does not require an account. Your makeup, progress, and other data are stored only on your device. We cannot restore data lost by deleting the App or by device failure or loss.
Article 4 (Ads)
The App is free to use and shows ads delivered by a third party (Google LLC). How ads handle information is described in the Privacy Policy.
Article 5 (Paid item "Remove Ads")
- The App sells a paid one-time item, "Remove Ads". Once bought, ads are no longer shown in the App.
- The price is the amount (tax included) shown on the App Store purchase screen.
- Payment is made with the payment method linked to your Apple ID when the purchase is confirmed.
- If you are a minor, please get your parent's or guardian's consent before buying.
- After reinstalling the App, or on another device with the same Apple ID, you can get your purchase back with "Restore Purchases" in the App.
- Due to the nature of the item, we do not accept returns, refunds, or cancellations after purchase. If the item is not applied correctly because of a problem with the App, please contact us (Article 12). To request a refund under Apple's refund policy, please apply directly through the App Store.
Article 6 (About the makeup pictures)
The makeup pictures, products, shades, tools, and their descriptions in the App are for play. They do not show the effects of real cosmetics or whether anything suits real skin.
Article 7 (Prohibited conduct)
- Conduct that violates laws or public order and morals
- Reverse engineering, modifying, or redistributing the App
- Using paid items by improper means
- Infringing the rights of others
- Interfering with the normal operation of the App
Article 8 (Intellectual property)
All intellectual property rights in the App and related content (programs, illustrations, designs, logos, text, etc.) belong to us or their rightful owners.
You may use the makeup pictures you create in the App for personal enjoyment, including saving them to Photos and sharing them on social media. Commercial use is not permitted.
Article 9 (Changes to and end of the App)
We may change the content of the App or stop providing it.
Article 10 (Disclaimer)
- We do not guarantee that the App fits your particular purpose, is free of defects, is safe, or is error-free.
- We are not liable for damages arising from using or being unable to use the App, except in cases of our willful misconduct or gross negligence.
- Ad content is provided by the third parties that deliver the ads. Services you reach from an ad are governed by their providers' terms.
- You are responsible for resolving any dispute between you and Apple or other third parties.
Article 11 (Changes, governing law, jurisdiction)
- We may change these Terms when we consider it necessary. The changed Terms take effect when posted on this page.
- These Terms are governed by the laws of Japan, and the Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to them.
